As the result of a fall on a staircase not built to code at a restaurant in Toronto in February 2004, a previously healthy and vibrant elderly lady became a quadriplegic. Dr. Dombrower provided an expert report and testimony at the trial successfully refuting the suggestion that the ladies fall was due to intrinsic (medical) causes. Total damages awarded amounted to $3,243,349.48.

The plaintiffs brought a wrongful death action against the Beacon Hill Lodges nursing home after the death of their elderly family member. Dr. Dombrower's report concluded there was no causation between the deceased's treatment at the defendant's facility, and his death and this conclusion was conceded by the plaintiffs and their own expert witness allowing for summary judgment and a dismissal of the action.

Dr. Dombrower's capacity assessment dated December 19th 2005 concluded that an elderly lady suffering from Alzheimer's Dementia, did not retain the capacity to change her POA in December 2005 and in all likelihood did not retain capacity in September 2005. As a result of this report the court ruled that the continuing power of attorney for property executed by the elderly lady on September 11, 2005, appointing her son as attorney, was void and permanently revoked. This ruling was appealed and upheld in appeals court.
